3.2 Workmanship. Expanded or exfoliated vermiculite shall be clean and free from extraneous particles per the Environmental Protection Agency (EPA) and Occupational Safety and Health Administration (OSHA) regulations.
3.3 Metric products. Although the metric system of measurement is the preferred system of weights and measure in CIDs, products manufactured to inch/pound units will be considered on an equal basis with those manufactured using metric dimensions, provided they fall within specified tolerances using conversion tables contained in the latest revision of FED-STD-376, Preferred Metric Units for General Use by the Federal Government, and all other requirements of this CID are met.
4. REGULATORY REQUIREMENTS
4.1 Safety Data Sheets (SDS). The SDS shall be prepared and submitted in accordance with
FED-STD-313, Material Safety Data, Transportation Data and Disposal Data for Hazardous Materials Furnished to Government Activities, and per Title 29 of the Code of Federal Regulations, section 1910.1200 (Hazard Communication). In the event of a conflict, 29 CFR 1910.1200 shall take precedence. If applicable, the contracting activity shall be provided an SDS prior to contract award, and the SDS shall be included with each shipment. (See 7.3).
4.2 Recovered material. The offeror/contractor is encouraged to use recovered materials to the maximum extent practicable, in accordance with paragraph 23.403 of the Federal Acquisition Regulation (FAR).
5. PRODUCT CONFORMANCE PROVISIONS
5.1 Product conformance. The products provided shall meet the salient characteristics of this Commercial Item Description, conform to the producer's own drawings, specifications, standards, and quality assurance practices, and be the same product offered for sale in the commercial marketplace. The Government reserves the right to require proof of such conformance.
5.2 Inspection requirements. If a product is manufactured to metric dimensions and those dimensions exceed the tolerances specified in the inch/pound units, a request should be made to the contracting officer to determine if the product is acceptable.
5.2.1 The contracting officer has the option of accepting or rejecting the product.
